Terms of Service

1. General Disclaimer (Risk Disclosure)

Chart Breakers / Nova Flow (“we”, “us”) provides educational content, market analysis, and software tools (indicators). We are not financial advisors, broker-dealers, or registered investment advisors.

Trading financial markets (Crypto, Forex, Futures, Stocks) involves a high degree of risk and is not suitable for everyone. You could lose some or all of your initial investment. Past performance of any trading system or methodology is not necessarily indicative of future results.

2. Account Terms

• Eligibility: You must be at least 18 years of age to create an account and use our services. By registering, you confirm that you meet this requirement.
• One Account Per Person: Each individual is permitted one account. Creating multiple accounts to abuse promotions, giveaways, or circumvent bans is prohibited and may result in termination of all associated accounts.
• Accurate Information: You must provide accurate and complete information when creating your account. You are responsible for keeping your account information (including email and TradingView username) up to date.
• Account Security: You are responsible for maintaining the security of your account credentials. We strongly encourage enabling two-factor authentication (2FA). You must notify us immediately if you suspect unauthorized access to your account.
• Account Sharing: Your account is personal and non-transferable. Sharing login credentials with others is prohibited.

3. Subscription & Billing

• Billing Cycles: Subscriptions are billed either monthly or annually depending on the plan you select. Billing occurs automatically at the start of each cycle via Stripe.
• Price Changes: We reserve the right to change subscription prices. Existing subscribers will receive at least 30 days' email notice before any price increase takes effect on their next billing cycle.
• Cancellation: You may cancel your subscription at any time from your account dashboard or Stripe billing portal. Cancellation stops future billing but you retain access until the end of your current paid period.
• No Partial Refunds: No partial refunds are issued for the remaining time in a billing cycle after cancellation.
• Failed Payments: If a payment fails, we may retry the charge. After repeated failures, your subscription will be paused and access to gated content will be restricted until payment is resolved.
• Free Trial: If a free trial is offered, it automatically converts to a paid subscription at the end of the trial period unless cancelled before the trial ends.

4. Digital Products & Refund Policy

Due to the nature of digital goods, all sales of Nova Flow indicators (Triple Threat, Divergence Scanner, etc.) are final and non-refundable.Once the intellectual property has been delivered or the TradingView access granted, it cannot be “returned.”

For subscriptions: You may cancel your subscription at any time via your user dashboard. Cancellation stops future billing, but no partial refunds are issued for the current billing cycle.

5. Intellectual Property

The indicators, scripts, course content, and code provided by Nova Flow / Chart Breakers are proprietary. You are granted a limited, non-exclusive, non-transferable license to use them for your personal trading only.

You may NOT resell, redistribute, decompile, reverse-engineer, or share our indicators with third parties. Violation of this term will result in the immediate termination of your access without refund and potential legal action.

6. Community Guidelines

The Chart Breakers community is a space for constructive trading discussion. By participating, you agree to:

• No Harassment or Bullying: Treat all members with respect. Personal attacks, hate speech, discrimination, and targeted harassment are strictly prohibited.
• No Spam: Do not post repetitive content, excessive self-promotion, or unsolicited advertisements. This includes referral link spam and promotional DMs.
• No Market Manipulation: Do not coordinate pump-and-dump schemes, spread intentionally misleading market information, or encourage reckless trading behavior.
• No Copyrighted Content: Do not share copyrighted material from other paid services, courses, or indicator providers.
• No NSFW Content: Keep all content appropriate. Explicit, violent, or otherwise inappropriate content is not allowed.
• Report Violations: Use the report function to flag content that violates these guidelines. Do not engage in vigilante moderation.

Moderators reserve the right to remove content and issue warnings, temporary mutes, or permanent bans at their discretion.

7. Acceptable Use

You agree not to:

• Scrape or Crawl: Use bots, scrapers, or automated tools to extract data from our platform.
• Redistribute Content: Share, repost, or redistribute course videos, strategy vault files, knowledge base content, or any other gated content outside the platform.
• Share Credentials: Share your account login, indicator access, or any other credentials with third parties.
• Circumvent Security: Attempt to bypass authentication, subscription checks, or other security measures.
• Overload Systems: Intentionally send excessive API requests or otherwise attempt to degrade platform performance.
• Impersonate Others: Create accounts that impersonate other users, staff members, or public figures.

8. No Profit Guarantees

Nova Flow / Chart Breakers makes no representation that you will achieve profits similar to those shown in our marketing materials or by other members. Trading results vary based on individual skill, risk management, and market conditions.

9. Termination

We may suspend or terminate your account and access to our services if you:

• Violate any provision of these Terms of Service or Community Guidelines.
• Share, redistribute, or reverse-engineer our proprietary indicators or content.
• Share your account credentials or indicator access with unauthorized third parties.
• Engage in harassment, spam, or other disruptive behavior on the platform.
• Attempt to circumvent subscription gating, security controls, or other platform protections.
• Create multiple accounts to abuse promotions or evade bans.

Termination for cause is immediate and without refund. We will make reasonable efforts to notify you of the reason for termination, except in cases of egregious violations.

You may also voluntarily close your account at any time by contacting support. See our Privacy Policy for details on data handling after account closure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Nova Flow / Chart Breakers and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data arising from your use of our platform or indicators.
• Trading losses incurred based on information, signals, or analysis provided by our tools or community members.
• Service interruptions, bugs, or technical issues.
• Unauthorized access to your account due to your failure to maintain security.

Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

The platform and all content are provided “as is” and “as available” without warranties of any kind, either express or implied.

11. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. When we make material changes:

• We will notify you via email at least 30 days before the changes take effect.
• A notice will be posted on our website and within the Chart Breakers community app.
• The “Last Updated” date at the bottom of this page will be revised.

Your continued use of the platform after the effective date constitutes acceptance of the updated terms. If you do not agree with the changes, you may cancel your subscription and close your account before the changes take effect.
